Terms of Service (AGB)

This is a convenience translation. The German version is the legally binding one.

§ 1 Scope and provider

These terms of service apply to the purchase of the paid additional features "Tabiyume Pro" via the website and app at tabiyume.de. Provider and contracting party is:

These terms apply in the version valid at the time the contract is concluded. Deviating terms of the customer do not become part of the contract unless the provider expressly agrees to their validity.

§ 2 Subject of the contract

Tabiyume is a digital travel-planning tool. The basic features are free to use. "Tabiyume Pro" unlocks additional features (e.g. cloud sync, booking management with travel wallet, nearby search, additional designs and further convenience features). The specific range of features results from the product description at the time of purchase.

Tabiyume Pro is digital content that is not supplied on a tangible medium. The provider may continuously develop, adapt or change individual Pro features, provided this is reasonable for the customer and the core benefit is preserved.

§ 3 Conclusion of the contract

The presentation of the products does not constitute a legally binding offer but an invitation to place an order. By initiating the payment process and completing the payment via the payment service provider, the customer submits a binding offer to purchase Tabiyume Pro. The contract is concluded upon confirmation of the payment and activation of the Pro features.

§ 4 Prices and payment

The total price displayed in the checkout at the time of the order applies. Tabiyume Pro is offered as a one-time payment; it is not a subscription.

Payment is processed by the payment service provider Stripe (Stripe Payments Europe Ltd.). Depending on your selection, payment methods such as credit card or PayPal are available. Payment data is processed exclusively by Stripe; the provider does not receive complete payment data. Stripe's terms apply in addition.

§ 5 Provision and activation

After successful payment, the Pro features are activated immediately for the user account linked to the purchase. The activation is tied to the account. No delivery on a physical medium takes place.

§ 6 Right of withdrawal

Consumers have a statutory right of withdrawal. The details result from the withdrawal notice.

Note on early expiry: In the case of contracts for the supply of digital content, the right of withdrawal expires early if the customer has expressly consented, before performance begins, to performance starting before the end of the withdrawal period, and has confirmed their knowledge that they lose their right of withdrawal upon the start of performance as a result of this consent (§ 356 (5) of the German Civil Code, BGB).

§ 7 Availability

Tabiyume is designed as an offline-first application; core usage is possible without a permanent server connection. For individual online features (e.g. cloud sync, collaboration, map and weather data) there is no entitlement to uninterrupted availability. The provider strives for operation that is as free of disruptions as possible, but cannot rule out interruptions due to maintenance or malfunctions.

§ 8 Warranty

The statutory provisions apply to the provision of digital products (in particular §§ 327 et seq. BGB). The provider makes the Pro features available in accordance with the product description and provides updates that are necessary to maintain conformity with the contract.

§ 9 Liability

The provider is liable without limitation in cases of intent and gross negligence as well as for damage resulting from injury to life, body or health. In cases of simple negligence, the provider is only liable for the breach of an essential contractual obligation (cardinal obligation), limited to the foreseeable damage typical for the contract. Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.

Tabiyume does not replace official travel, timetable or safety information. No guarantee is given for the accuracy, completeness or currency of third-party content (e.g. map, weather, timetable or price data).

§ 10 Data protection

Information on the processing of personal data is provided in the privacy policy.

§ 11 Changes to these terms

The provider may amend these terms with effect for the future where this is necessary for a valid reason (e.g. changes in the legal situation or in the range of features) and the customer is not unreasonably disadvantaged as a result. For purchases already completed, the version valid at the time of purchase applies.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.

The EU Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.
